Terms of service

Last updated 11 October 2026. These terms apply when you buy services from Up Start Digital Group Pty Ltd (ABN 13 680 098 542), trading as Up Start Digital ("we", "us"). Each project also has a written proposal or agreement; if it differs from these terms, the proposal or agreement applies.

Quotes and proposals

Prices are quoted individually in writing and are valid for 30 days. We are not registered for GST, so no GST is charged. Work starts only once you accept a proposal in writing or pay the deposit or fee it names. We never bill for work you have not agreed to.

Deposits and payment

Builds usually start with a 10% holding deposit. It is fully refundable until we show you the finished work; if you choose not to proceed at that point, we refund it in full and you keep nothing we built. The balance is due when you accept the finished work. Fixed-fee services, such as the Cost Takeout Audit, are paid upfront. Monthly services are billed in advance and can be cancelled with 30 days' notice.

Refunds

Apart from the refundable deposit above, if we do not deliver what the proposal describes, tell us within 14 days and we will fix it or refund the affected part. Nothing in these terms limits your rights under the Australian Consumer Law.

Lead credits (Battery Match)

Lead credit packs are prepaid and do not expire. A lead that is a duplicate, has a wrong number or is outside your chosen area can be returned within 3 days and the credit is replaced. Leads are delivered only after the homeowner has confirmed consent by text.

Your content and accounts

You own your business content, data and, once paid in full, the website, branding and automations we build for you. Accounts we set up are created in your name or transferred to you on request. We may show the work in our portfolio unless you ask us not to.

Liability

To the extent the law allows, our total liability for a project is limited to the fees you paid for it, and we are not liable for indirect losses such as lost profit. We are not responsible for outages or changes made by third-party platforms (for example Facebook, Google or payment providers).
